Privacy Policy
Last updated October 7, 2026
Atlantic Business Consulting & Capital, LLC, doing business as Finance Factory (Finance Factory, we, us, or our), explains in this Privacy Policy how we collect, use, disclose, and protect personal information and how you can exercise privacy choices. It applies to our websites and application pages that link to this policy, and to related funding inquiries, document submissions, telephone calls, text messages, emails, and customer services.
Personal information means information that identifies you or can reasonably be linked to you. This policy does not replace a separate financial privacy notice, credit authorization, communications consent, or agreement provided for a particular service. Where a separate notice applies, it governs the practices and choices described in that notice. Nothing in this policy limits rights provided by law. Reading this policy or visiting our website does not, by itself, authorize a credit inquiry or marketing calls or texts.
1 Information we collect
The information we collect depends on your interaction with us and the funding service you request. We may collect the following categories:
Contact and identity information. Name, mailing and property addresses, email address, telephone number, date of birth, and, when needed for a funding application or identity verification, Social Security number or government identification.
Business and professional information. Business name, ownership, formation date, industry, location, revenue, employer, occupation, and information about business owners, applicants, guarantors, or authorized representatives.
Financial and credit information. Requested funding amount and purpose, income, assets, liabilities, credit scores and authorized credit reports, banking information, tax returns, bank statements, pay stubs, financial statements, and documents needed to evaluate or process a request.
Application and service information. Information entered into application forms, saved application progress, funding preferences, submitted documents, authorizations, consent records, application status, and records of our services.
Communications. Emails, texts, chats, call records, and, where lawful notice and consent requirements are satisfied, audio recordings, transcripts, summaries, and communications with our representatives or AI assistants.
Device and website activity. IP address, device and browser information, cookie identifiers, referring pages, pages viewed, link clicks, form events, timestamps, and security logs.
Inferences. Funding preferences, potential product matches, or follow-up needs inferred from the information described above.
Social Security numbers, government identification, financial account information, and some other information receive heightened protection under applicable law. We use such information for requested services, identity verification, security, and legal compliance, and for other purposes only where permitted by law and with any required consent. Please provide information about another person only if you have authority to do so. Avoid sending Social Security numbers, account credentials, or full financial documents by ordinary email or text; use the secure submission method we provide.
2 Where information comes from
We collect information directly from you and your authorized representatives; from lead or referral partners through which you requested funding assistance; from funding providers, processors, identity verification services, and credit reporting sources when legally permitted; and from your use of our websites and communications systems. We may also use lawfully available public business or property records relevant to your request.
We may prepopulate an application with information previously supplied by you or a referral partner. Please review and correct it before submitting. Depending on the form, we may save information as you enter it so you can resume an application and so we can assist with an incomplete request, subject to applicable consent and communications preferences.
3 How we use information
We use personal information to respond to inquiries; assess potential funding options; prepare funding estimates or strategy reviews; match you with providers; process applications and documents; verify identity; prevent fraud; administer customer relationships; provide application reminders and support; maintain consent and preference records; measure and improve our services; secure our systems; and meet legal, regulatory, recordkeeping, and dispute-resolution obligations.
We may also communicate about our services, subject to applicable consent requirements and your preferences. An estimate, preliminary match, or strategy review is not a guaranteed approval, rate, or offer. Funding providers establish their own underwriting and approval requirements.
4 How we disclose information
Funding providers and processors
We may disclose relevant contact, identity, business, financial, application, and communications information to lenders, banks, financing providers, brokers, and processors involved in evaluating, arranging, or processing the funding services you request. We may receive referral or other compensation for our funding services. We do not sell applicant or customer lists to unrelated companies for their independent marketing.
Providers that independently evaluate your request are responsible for their own information practices. Review their privacy notices and authorizations. They may retain information even if you do not obtain funding. An opt-out submitted to Finance Factory does not automatically change a provider’s independent records or communication preferences.
Service providers
We disclose information needed for operational support to vendors providing website hosting, application and document systems, customer relationship management, communications, call recording, AI assistance, analytics, identity verification, security, and professional services. The categories disclosed depend on the vendor’s role and may include the categories listed in Section 1. These providers are subject to appropriate contractual restrictions governing their processing of information on our behalf.
Legal needs and business transactions
We may disclose relevant information to regulators, courts, law enforcement, attorneys, auditors, or other recipients when required or permitted by law, to investigate fraud or security incidents, protect legal rights, or resolve disputes. Information may also be disclosed in connection with a proposed or completed merger, acquisition, financing, reorganization, or sale of business assets, subject to applicable protections and legal requirements.
We may use or disclose aggregated or deidentified information that cannot reasonably identify you. We maintain deidentified information in that form and do not attempt to reidentify it except where permitted by law.
5 Credit information and authorizations
A credit inquiry is governed by the specific credit disclosure and authorization presented for the relevant service and by applicable law. A soft inquiry generally does not affect your credit score; a hard inquiry may affect it. A funding provider may require a separate authorization and may perform a hard inquiry as part of its application process. Review the inquiry type and provider’s disclosure before proceeding.
This Privacy Policy does not itself provide permission to obtain a credit report. We obtain or use credit information only with a legally permitted purpose and any authorization required by law. Vermont residents receive any additional credit-report consent protections required by Vermont law.
6 Calls texts emails and AI assistance
We may communicate through representatives and AI-assisted systems, including automated text, email, and voice tools. AI tools may help answer questions, organize information, summarize communications, identify potential funding matches, and route inquiries to our team. Information processed by these tools may include your contact details, application information, and communications. You may request assistance from a human representative by contacting us.
Where permitted by law and with required notice and consent, we record or transcribe calls for customer service, quality assurance, training, compliance, and recordkeeping. This policy is a disclosure of our practices and does not replace any recording consent or notice required at the time of a call.
Marketing calls and texts, including calls using an artificial or AI-generated voice, are subject to applicable consent requirements. Where consent is required, it is obtained separately. Consent to marketing communications is not a condition of purchasing our services.
To stop marketing texts, reply STOP or use another reasonable method to communicate your request. For help, reply HELP or contact us. Message frequency varies, and message and data rates may apply. To stop marketing emails, use the unsubscribe link. To request that we stop marketing calls, call or email us. We honor valid revocation requests as required by law; a limited nonmarketing confirmation may be sent where allowed.
Mobile information, including telephone numbers collected for our text messaging program, will not be shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties, except with providers supporting delivery and operation of our messaging program. Contact information separately supplied for a requested funding application may be shared with funding providers as described in Section 4; it does not transfer consent to our text messaging program.
7 Cookies website measurement and browser signals
We use cookies and similar technologies for website operation, security, saved application progress, and service measurement. These technologies may collect the device and activity information listed in Section 1. Cookie identifiers and IP addresses can be personal information, even when they do not include your name.
You can manage cookies through your browser settings. Blocking necessary cookies may affect features such as saved application progress. We obtain consent for nonessential technologies where required by applicable law. We do not use financial application contents, credit information, Social Security numbers, or uploaded documents for advertising audiences.
Where applicable law requires us to honor a recognized opt-out preference signal, including Global Privacy Control, we treat it as a request to opt out of covered sale, sharing, or targeted advertising for the browser or device that sends it and extend it to an associated profile where required. This is different from the older Do Not Track setting, which does not have a uniform implementation standard. Browser settings do not unsubscribe you from calls, emails, or texts; use the methods in Section 6.
8 Retention and security
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including processing your request, providing services, maintaining required records, preventing fraud, resolving disputes, and complying with law. Retention varies by category and depends on the nature of the information, the relationship, legal obligations, and operational needs. Recordkeeping requirements may prevent immediate deletion of some application or transaction records.
When information is no longer needed, we delete or deidentify it in accordance with our retention procedures, subject to lawful holds and backup cycles. We may retain limited suppression records to honor opt-outs.
We maintain administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure. If an incident requires notice, we provide notice in accordance with applicable law.
9 Your privacy choices and rights
You may contact us to ask about information we maintain, request corrections or deletion, change communication preferences, or raise a privacy concern. Depending on your state of residence, our legal obligations, and the information involved, you may have rights to:
- Confirm processing and access personal information, including a portable copy where applicable.
- Know the categories of information collected, its sources, purposes, and recipients, and obtain additional recipient information where required.
- Correct inaccurate information and request deletion, subject to lawful exceptions.
- Opt out of the sale of personal information, sharing for cross-context behavioral advertising, or targeted advertising, where applicable.
- Limit certain uses or disclosures of sensitive information, or withdraw consent where required.
- Opt out of certain profiling or automated decisions with legal or similarly significant effects, where applicable, and appeal a denied request where provided by law.
To submit a request, email Connect@FinanceFactory.com or call 800-691-6727. Tell us the type of request and provide enough information to identify the relevant interaction. You do not need to create an account. Do not send a full Social Security number or financial account number in your request.
For requests that require verification, we use reasonable methods appropriate to the information involved and may ask for additional information. We do not require identity verification for opt-outs where law prohibits that requirement. Authorized agents may submit requests, subject to applicable proof-of-authority and verification requirements.
We respond within the period required by applicable law. If a permitted extension or exception applies, we explain it as required. We do not unlawfully discriminate against you for exercising privacy rights. Some requested services may be unavailable if information necessary to provide them is deleted or withheld.
Where you have an appeal right, email Connect@FinanceFactory.com with Privacy Appeal in the subject line and describe the request and denial. We respond within the applicable legal deadline. If an appeal is denied, we explain any available complaint process, including how to contact the relevant state attorney general or privacy regulator.
10 State and financial privacy notices
California residents may have rights under the California Consumer Privacy Act, including the rights described in Section 9, where that law applies to us and to the information involved. Certain information collected, processed, or disclosed under financial privacy or credit reporting laws may be exempt; those exemptions do not automatically cover every website interaction.
For California residents, the categories, sources, purposes, and recipient categories described in Sections 1 through 4 also describe our practices during the preceding 12 months to the extent applicable. We use sensitive personal information for the purposes described in Section 1, rather than to infer sensitive characteristics about you. California residents may also contact us about disclosures for third parties’ direct marketing under California’s Shine the Light law.
Maryland and other state privacy rights apply where the relevant law covers the business and information involved. Financial institution, financial information, credit reporting, and business-context exemptions vary by law. We evaluate requests under the applicable requirements rather than treating all personal information as exempt.
For financial products or services covered by the Gramm-Leach-Bliley Act or state financial privacy laws, we provide any separate notices and sharing choices those laws require. California and Vermont residents receive additional sharing or consent protections where required. Disclosures necessary to process a requested transaction, made with valid authorization, or otherwise permitted by law may be subject to different rules from unrelated marketing disclosures.
11 Children and visitors outside the United States
Our services are intended for adults age 18 and older and are not directed to children. We do not knowingly collect personal information from children under 18. If you believe a child provided information, contact us so we can investigate and take appropriate action.
Our services are directed to people in the United States. Information may be processed in the United States and in other countries where our service providers operate. Applicable privacy protections may differ. Where legally required, we use appropriate safeguards for international transfers.
12 Third party services and policy updates
Third-party websites and independent providers have their own privacy practices. A link to their service does not mean that this policy governs their independent processing.
We may update this policy to reflect changes in our services, practices, or legal requirements. We post the revised policy and update its date. For material changes, we provide any additional notice or consent required by law. Continued website use does not replace consent where the law requires it.
